In addition to holding the authority to establish stricter regulations than the federal government, the Province is responsible for many matters of implementation, such as how and by whom cannabis may be sold and where it may be consumed.
As of December 2017, the Province of British Columbia has determined that the minimum age to possess, purchase and consume cannabis will be 19, and cannabis will be sold in both publicly- and privately-owned retail locations. In February 2018 the Retail Sales framework was released.

There is a lot of demand to open cannabis retail outlets in Nelson. This could result in a variety of impacts for retailers, consumers and the public. The City wants to ensure zoning and regulations, such as location and number of retail outlets, are acceptable to residents and businesses in Nelson.
Existing rules, for example, require a minimum 1-kilometre separation between liquor stores.
In addition, cannabis legalization is intended to meet a number of public health goals that local regulations must address.
Nelson’s regulations on medical cannabis were temporary measures until cannabis regulations were introduced. The only legal method to obtain it is via mail order. Under the upcoming legislation, retail cannabis outlets must be licensed by the Province and purchase their supply only from the Province. All other outlets will be considered illegal and will be subject to fines and the criminal code.

The provincial and federal governments are regulating non-medical cannabis as the federal government has decided to retain the current rules for medical cannabis stipulating that the only legal method to obtain it is through mail order from licensed production facilities.
With the legalization of cannabis for recreational purposes, the City of Nelson is taking the opportunity to consult with the community on where cannabis should be consumed, grown, and sold.
City Council adopted a moratorium on recreational cannabis in January 2018. The moratorium places a freeze on new cannabis businesses as an interim measure to allow time to sufficiently consult with the community leading up to the national legalization of cannabis in summer 2018. This is being done to ensure that the public has a say in the future of cannabis regulations in Nelson.
After consultation and significant deliberation, City Council will make a decision on the regulations that will pertain to legalized cannabis.
Existing medical cannabis dispensaries will not receive preferential treatment or priority. They will be able to apply for a provincial licence in order to continue to operate as a retail cannabis outlet following legalization in summer 2018.

The City has done its best to ensure that each dwelling unit receives a mailing, but errors may have occurred. Note that home-based businesses will not receive a separate feedback form, as a resident feedback form will be mailed to that address.
In order to ensure the feedback received is as representative as possible of Nelson, a mail-survey will be the only method to provide feedback at the resident-level. By ensuring that each household has an equal chance to provide feedback, the goal is to have statistically significant results.
The City wants to ensure that Nelson residents and businesses have the loudest voice in providing feedback. It is difficult to configure an online survey to ensure that only those who live and own businesses here are able to participate, and participate only one time.
Additional face-to-face events are being held for the public and for community groups related to youth, families, seniors, social services, public health, and business to obtain further feedback and dialogue that might be relevant to these groups.
This has yet to be determined by the Province. It is possible that cannabis lounges or cafes will not be yet permitted this summer.
Edible cannabis products will not be legal or legally sold in 2018. The federal government has announced that they will become legal in summer 2019.
At this time, no commercial production of cannabis is permitted within City limits.
Once legalized later in 2018, adults 19 and older will be able to grow cannabis at home for personal use, but not for resale. A maximum of four (4) plants will be permitted by federal law. The Province has not determined whether it will adopt further restrictions.
In British Columbia, all non-medical cannabis products will be distributed through the provincial Liquor Distribution Branch. As with alcohol sales, this means that retail businesses will not be permitted to grow their own product or source it from a third-party.
Most cannabis-related concerns around public health and safety fall under federal and provincial jurisdiction. Both of these levels of government have clearly expressed a commitment to harnessing legalization to address existing public health and safety issues with cannabis. This includes their intent to keep cannabis out of the hands of people under the age of 19 and combatting impaired driving. Cannabis is being treated similar to tobacco and will be strictly controlled, included restrictions on branding and advertising.
Once cannabis is legalized:
The federal government has stated that individuals will be able to grow up to four cannabis plants per household for personal use from licensed seed or seedlings. The Province may also put in further restrictions around number of plants, as well as around public visibility and security requirements and administrative penalties.
Currently, no new cannabis businesses, medical or otherwise, are permitted in Nelson at this time.
The Province is expected to begin accepting applications for provincial licenses prior to July 2018. An applicant will have to meet all local, provincial, and federal regulations. The current medical dispensaries will need to apply for a provincial licence to continue to operate, which requires meeting all local, provincial, and federal regulations. It is anticipated that they will be treated the same as any other applicant.
Even once the federal government has formally legalized cannabis, both the provincial and municipal levels of government will need to have regulations in place before cannabis businesses are authorized to operate. The City of Nelson expects to have new regulations prior to legalization. The public will be thoroughly consulted in the coming months on what those rules could be. All cannabis-related businesses will have to comply with federal, provincial, and municipal regulations and obtain all necessary licencing, including a business licence from the City of Nelson.
It is anticipated that both local government and the public will be able to comment on private retail applications prior to the Province making a decision to approve or deny an application.
The Province has announced that it will operate cannabis stores. Where and how many have not been determined at this time. These outlets will also need to meet local government regulations. Some communities have expressed interest in only allowing government-operated stores.

Generally, no, backyard burning is not allowed. At the discretion of the Fire Chief, however, a brief period of time may be opened up to the citizens to participate in a limited backyard burn, usually in spring. Intended to mitigate build-up of hard to remove fuel, it is not a guaranteed annual occurrence.
When backyard burning is allowed, citizens must come to the Fire Hall to apply for a temporary burn permit. Burning without a permit may result in a fine or a fee for service. Applicants must meet certain basic safety and burn material requirements prior to a permit being issued to an address. Once a permit has been issued, owners must call the fire hall prior to lighting their pile of yard debris. This helps establish if the day’s conditions are favourable for burning, and helps avoid the arrival of a fire truck to your address. There is a $10 fee for the permit, payable by cash or cheque at the fire hall.

Yes, that is highly encouraged to demonstrate your achievement of the evaluation criterion of adaptability to different sites. The successful designs are to be flexible and adaptable to different lot configurations and topographies of City of Nelson.
Lot depth is typically 120 ft. and width is often 50 to 75 feet, but we don’t have quite the same ‘typical’ lot width or configuration as other cities, which you can see by looking at the cadastral map layer (go to www.bcassessment.ca and start poking around; try 418 Robson St, 711 Regent St, or 1808 Fort Sheppard for example).

We expect most people to submit at the last minute, on September 2nd, therefore that decision would be made on September 3rd. Based on the number of inquiries, I would be surprised if we felt we needed to extend the deadline, but of course we cannot close that door quite yet.

No, they are not part of the building footprint. In fact, the building footprint excludes eaves, open air porches, balconies, open air decks, and exterior stairways altogether, regardless of height (see definition of “building footprint” in the Zoning Bylaw).

The word "images" is plural.
This rule seems to allow additional images and pages to be submitted. If so, is there a limit?
Gross floor area: the definition thereof in the Zoning Bylaw excludes crawl spaces, subdecks, carports, and parking garages from counting towards GFA. The minimum ceiling height is 1.95 metres. Below that, it is considered a crawl space.
The entrance form is to be submitted with the first-round submission, thus before September 2nd.

On page 4 of the brief it notes that one of the top three prizes will be designated to a local submission. Does this mean that local entries are preferred or are required for the competition award to move forward? Are other teams from out of province welcome to submit or is this intended to be a regional competition?
Entrants from across Canada are welcome to participate. The paragraph you are referencing says that if there are at least three entrants from the region, then the Design Review Panel will be “expected to” designate at least one regional entrant. Therefore, the competition does not require any local entries, but if there are multiple local entries, assuming that they are quality entries, the Design Review Panel will be encouraged to give one of them extra consideration. It would be inaccurate to state that local entries are preferred. Ultimately, the Design Review Panel has discretion and is not required to aware a prize locally.

To have the electrical service at the address you are moving into transferred into your name, to have your account transferred from your existing location to the new location, or to close your account call a Nelson Hydro Customer Service Representative at 250-352-8206 Monday to Friday, 8:30 a.m. to 4:30 p.m. and apply to, or you can come directly to City Hall.
If terminating an account, please allow three working days' notice in advance of the date you want the service to cease. If the termination of service needs to involve removing electrical lines from a mobile home or building, please advise Nelson Hydro (the process may take longer).

Contact Nelson Hydro at 250-352-8240, Monday to Friday 7 a.m. to 3 p.m. to apply for a new service or an upgrade. You will need to enlist the services of a licensed electrical contractor. Your contractor can call Nelson Hydro on your behalf, or you can call directly. All required permits and payments must be received by Nelson Hydro before connection can occur.
For first-time electrical service to a vacant lot, a site visit is necessary. Before any construction can begin, all permits, payments and required easements or rights-of-way must be in place.

There are three simple ways to pay your bill:
Don’t be left in the dark! If payments are not received on time, penalties will be applied. If your payment is not received within 30 days, you will receive an Overdue Notice with a penalty. If a payment has not been received after 45 days from the initial bill, a Disconnect Final Notice will be sent, which allows for payment to be made within 5 days. If payment is still not received at this point, service will be disconnected.
All City of Nelson Hydro meters are read bimonthly. With close to 10,000 meters in the city, the reading of the meters is done in cycles. The number of days in your billing period may vary based on these cycles. Each billing period will be roughly 60 days and you will receive your bill approximately one week after your reading has been taken. All bills are based on consumption, whether estimated or actual. The time of year, daylight hours, weather conditions, the efficiency of appliances and the hot water temperature setting in your home calm all affect your bill. Being energy-savvy keeps cost down! Power outages may be planned for upgrades or repairs. planned power outages, Nelson Hydro makes every effort to notify customers through by telephone or door tag notifications.
Power outages may be caused by other circumstances, including wind and weather, animals, fire, or motor vehicle accidents. we are unable to notify customers in instances where the outage is out of our control. Flickering lights may be caused by close proximity if trees to power lines. If concerned, call Nelson Hydro.
Heat waves and other times of unusually high power demand can overload our equipment and cause an outage. Conserving energy at peak times is a great way to help!
First, verify that your whole house is out of power. You may have only blown a fuse or tripped a circuit breaker and need to check your service panel. Check to see if nearby streetlights are off, or find out if your neighbours are out of power.
If you have verified that the outage is not related to your own power source, turn off or disconnect any appliances you were using when the outage occurred. Leave one light on so you will know when power has been restored.

Trees sometimes pose a danger to power lines and to our customers, and Nelson Hydro maintains a three-metre clearance from primary distribution power lines for public safety by removing or trimming trees as necessary.
Nelson Hydro does not trim around service lines to homes, which is the customer’s responsibility. You can hire a licensed arborist, or you can do the work yourself. You must contact Nelson Hydro and communications companies (such as phone and cable) to drop the service lines while the work is being done. Stay at least 10 metres away from the downed power line. Watch for conductive materials like fences and secure the area. Do not touch or go near the wire; even if it is on the ground, it may still be live and could kill you. Contact Nelson Hydro (24-hour toll-free) at 877-324-9376 (877-32-HYDRO).
Those warning signs are real! Nelson Hydro Substations contain high voltage equipment of up to 63,000 volts. Even much lower voltages can jump through the air and reach you. Contact with high voltage electricity can result in injury or death.
Anyone planning to excavate is required to contact BC One Call at least three working days before the excavation begins. This must be done before contacting anyone at Nelson Hydro.

When you first register for the online portal, the account number you use will be your primary account and will automatically be set to “paperless” billing. If you have multiple accounts, registering your primary account will not change the billing option for your secondary accounts.

Yes, you can pay your bill using “Pay My Bill” 1 or “Pay Now” 2 links on the homepage of the Hydro portal. You do not need to register your account or sign in to pay your hydro bill. After you select Pay My Bill you will be required to enter your Customer 3 and Account 4 numbers which you can find on the top right-hand side of your hydro bill. You will then be directed to a secure payment website to finish the payment process.
You will only be able to view hydro E-bills for your online registered accounts that have the “paperless” billing option selected. Bills that are created and sent as “paper” bills, either before or after registering the account, will not be available for viewing, downloading or printing on the online portal. On the Billing 1 screen, if a “paperless” bill is available for download, there will be a download link in the eBill column 2.
No, signing up for hydroportal.nelson.ca will not change any of your current payment plans. If you are set up for Pre-Authorized Payments you can see what type of plan you are on as well as your next payment amount and draw date on the Transactions 1 screen. To meet the rising cost of providing power, Nelson Hydro must adjust its rates for both city and rural customers. This rate increase is necessary to cover the 4.36% rate increase in our power purchase costs from FortisBC and includes other direct inflationary costs such as supplies and labour. These factors alone result in Nelson Hydro customers requiring a 3.32% general rate increase effective April 1, 2021. You can find the application submitted here.
The April 1 increase is done to reduce the impact on customers for any particular calendar year.
An increase on January 1st would coincide with most customers’ highest billing period of the year. By delaying the increase until April, when we see more moderate temperatures, it helps alleviate some of the pressure customers might feel from any increases. This also allows the BCUC time to review the rate increase application and grant its approval prior to the date of the increase.
The increase is the weighted average of the Jan-March period and the April to December period which in this case would be 0% for the first 3 months and 3.32% for the last 9 months.
In 2021, this results in a 2.3% for the calendar year as reported by the Nelson Star.
The COSA (Cost of Service Analysis) study is an intensive review to ensure that each customer class both urban and rural is paying its share of each service provided. This review looked at the hydro rates and services in detail and recommended an adjustment to rural rates in order to cover the additional costs incurred to provide service to these areas. Based on the 2019 data, Nelson Hydro collects $1.5 million less from rural customers than it costs to service the rural areas.
Nelson Hydro has also filed a Cost of Service Analysis (COSA) and Rate Design Application with the BC Utilities Commission (BCUC) requesting, among other items, approval to increase rural residential rates. You can find the report submitted here.
Rates would be increased by 5.72% on September 1 in 2021, 2022 and 2023. This adjusts rural rates to those recommended in the cost of service analysis report which indicates current rates do not recover the full costs of serving the rural customers by approximately $1.5 million per year.
To ease the impact of rate rebalancing, rate increases are being phased in over three years to help reduce the impact on our rural customers. With the full phase-in of rates, the typical rural residential customer’s power bill would be approximately 4.4% lower than the 2020 FortisBC rate. FortisBC has typically had higher rate increases than Nelson Hydro, so the rural residential rate should be even lower after the 3-year phase-in.
There are 25 kilometres of transmission lines, 233 kilometres of distribution lines, and more than 5,000 power poles in the rural service area, more than double what is in the City. Therefore, it takes more resources to supply safe, reliable power to our rural customers than to our City of Nelson customers.
Our extensive Vegetation Management Program works year-round to reduce the impact of fallen trees and branches during windstorms. In the past 4 years, we have spent $2.6 million, 86% of which was in the rural areas. This in turn reduces power losses and the cost to repair, as well as safety.
If the BCUC application is approved, rural residential customer rates would be increased by 5.72% on September 1, 2021, September 1, 2022, and September 1, 2023.

Rates for our customers vary, depending on their use. For example, homes that have access to natural gas for heating would pay less for hydro and more for gas.
Based on an average use of 850 kWh/month, a typical rural customer’s annual Nelson Hydro bill was $1,179 in 2019 a or $98 per month. In 2023, this same customer’s bill would be $1,393 or $116 per month. In 2023, the typical customer would pay less than $4 per day for all of their electrical use.
Once the COSA recommendations for the city residents are also implemented, the city electrical rates will reflect where they had been historically, which is 6% less than the rural area.

Nelson Hydro was established in 1892 and expanded to service rural area customers in 1922.
Revenue and profits go directly back to the City of Nelson to provide safe, reliable electricity at a lower cost than the alternative of FortisBC. It also funds ongoing capital improvements such as the construction of the submarine cable connection for Harrop and at Lakeside to the Northshore, and into those many services that both rural and city residents enjoy such as parks, arts, and heritage street lights in the downtown.
Nelson Hydro is proposing that rural rates reflect a true Cost of Service model that is standard for other regulated utilities such as FortisBC. Like all utility companies, this includes a rate of return as a way to generate revenue and a way for investors to make a return on their investment. For Nelson Hydro, the City of Nelson is the investor, as the owner of the electrical assets. Unlike a private utility, this return on investment doesn’t go into the pockets of an external investor, but rather it is re-invested in the community. It pays for things like parks, arts, the heritage street lights in the downtown, all for the benefit of everyone who lives, works or plays in and around the City.
With no industrial tax base and taxation only coming from residential and small commercial businesses, these things simply would not be provided at today’s levels if the City of Nelson was not making this return.
Rates have always been higher in the rural area for commercial and street light customers as compared to the City of Nelson. The rural residential rates were also higher for almost 75 years until 1995 when City Council chose to raise city rates to equal rural residential rates to generate additional funds to begin a long-term capital renewal program.
This was at a time when the cross arms on the Hydro poles that hold up the live wires, were literally falling off the poles and lying on the street in the city. The increase in 1995 was meant to be a temporary increase, but the need for capital renewal funds necessitated City Councils to continue with these higher city rates to generate those needed funds. The impact of the capital program on rates in both the City and Rural areas was not quantifiable until the COSA was completed.
The program is expected to begin its first phase of rollouts in mid-2022. The program will be implemented in phases to ensure smooth uptake in the community and will take 1-2 years to engage the whole community.
All residents living within Nelson's city limits will be eligible to participate in the organics diversion program however rollout will take place in phases.
A pre-treatment appliance is an in-home clean technology that transforms food waste into a natural soil amendment. About the size of a bread maker, pre-treatment appliances pulverize and dehydrate food scraps breaking them down in a matter of hours. The weight and volume of food scraps are reduced by ~90%, leaving users with sterile biomass that is easy to store and can be used in backyard gardening or collected by the City.
Pre-treatment is an alternative method to a conventional curbside compost program. Pre-treatment works by mashing and dehydrating household food waste and produces a sterile and odour-free soil amendment that is ~90% less in weight and volume. Pre-treatment doesn’t attract pests, is easy to store, and requires fewer collection days than other curbside compost programs.
Organics will be collected up to 8 times a year, once the program is fully operational.

Across Canada, there were estimated 1.25 million people earning minimum wage, or about 8 per cent of the country’s 15.3 million salaried employees in 2017.
